Cybernet Entertainment LLC (d/b/a Kink, Kink.com, Kinkmen.com, KinkTrans.com, KinkVR.com, TwistedFactory.com, and C.E. LLC) (“Kink,” “we,” “us,” or “our”) is committed to preventing individuals under the age of 18 (or the applicable age of majority in their jurisdiction) from accessing our websites and the products and services available on them (collectively, the “Services”). This Age Verification Policy explains who must verify their age, the methods we use to verify age, how we handle the information collected during that process, and your rights and choices. This Policy should be read together with our Privacy Policy and Terms of Use.
1. Our Services Are Not for Minors
Access to and use of the Services is strictly prohibited for anyone under the age of 18 or the applicable age of majority in the jurisdiction from which the Services are accessed (a “Minor”). By accessing or using the Services, you represent and warrant that you meet this age requirement. We do not knowingly permit Minors to register for, or otherwise access, the Services.
2. Who Must Verify Their Age
Depending on the laws that apply to your location, you may be required to complete an age verification check before you can view certain content or use certain features of the Services. The specific point at which verification is required, and the method used, varies by jurisdiction in order to comply with applicable state, federal, and international age verification laws. Section 6 below summarizes the method currently used in the jurisdictions where a specific legal age verification requirement is in effect.
3. How We Verify Your Age
We use one or more of the following methods to verify that you meet the applicable minimum age, depending on the laws of the jurisdiction from which you are accessing the Services. Where more than one method is permitted, we use the option that is least burdensome for you while still satisfying the applicable legal requirement.
Email-Based Age Check
In most jurisdictions, we verify your age using an email-based age estimation or verification method. This process draws on data associated with your email address to assess whether you meet the applicable minimum age, without requiring you to submit a government-issued ID or a photograph of yourself.
Facial Age Estimation
In jurisdictions where email-based verification is not an available or accepted method, we may ask you to complete a facial age estimation check. This involves capturing a live image or short video of your face, which is analyzed by our third-party age verification provider to estimate whether you meet the applicable minimum age. The image is used only to generate an age estimate and is not used to identify you by name.
Government ID Scan and Face Match
In jurisdictions that require it, or where you choose it as an available alternative, you may be asked to submit a government-issued identification document together with a live selfie. Our third-party age verification provider compares the photo on your ID to your selfie to confirm that the person completing verification is the same person pictured on the ID, and extracts your date of birth from the document to confirm you meet the applicable minimum age.
4. Our Third-Party Age Verification Provider
We do not perform age verification ourselves. Instead, we engage a specialized third-party age verification service provider, VerifyMy, to perform the checks described in Section 3 on our behalf. This provider is contractually restricted from using the information you submit for any purpose other than verifying your age and, where applicable, your identity, and from retaining that information for longer than necessary to complete the verification (see Section 6, Data Retention). We do not receive or store the underlying government ID images, facial images, or biometric templates used to complete verification; we typically receive only a confirmation of the verification result (for example, “over 18: yes/no”).
5. Biometric and Identity Information
Where facial age estimation or ID scan and face match verification is used, our third-party provider processes biometric information — a mathematical representation of your facial features derived from your live image or selfie — to (a) confirm that you are a real, live person, (b) estimate your age, and/or (c) match your selfie against the photo on your government-issued ID. This biometric processing is performed solely to grant or deny you access to the Services in jurisdictions with legal age verification requirements. Where required by law, you will be asked to consent to this processing before it occurs, and you may withdraw your consent at any time by contacting us at the address in Section 11; note that withdrawing consent may mean you are unable to access age-restricted portions of the Services. 6. Data Retention
We and our third-party age verification providers retain information collected during the age verification process only for as long as necessary to complete the verification, comply with applicable legal and recordkeeping obligations (including, where applicable, requirements to retain proof that verification occurred), resolve disputes, and enforce our agreements. Government ID images, biometric templates, and facial images are generally retained by our third-party providers, not by Kink, and are handled in accordance with that provider’s own data retention practices and applicable law.
7. No Circumvention; Consequences of False Information
You may not use false, misleading, or another person’s information or identification documents to complete age verification, and you may not attempt to circumvent, disable, or interfere with our age verification measures. If we determine, at any time, that a user has provided false information during age verification, or is otherwise a Minor, we will immediately terminate that user’s account and revoke access to the Services. We may also take any other action available to us under our Terms of Use or applicable law, including reporting the matter to law enforcement where appropriate.
8. If We Learn a Minor Has Accessed the Services
If we learn or have reason to believe that a Minor has registered for or otherwise accessed the Services, we will promptly terminate that person’s account, deny further access, and delete any personal information we collected from that person, except where retention is required to comply with a legal obligation. If you believe a Minor has accessed or registered for the Services, please notify us immediately using the contact information in Section 11.
9. Your Choices
If you do not wish to complete age verification, you will not be able to access age-restricted portions of the Services. Where a jurisdiction offers more than one verification method, you may be able to choose which method to use; where only one method is legally permitted, that method will be presented to you without alternatives.
10. Changes to This Policy
We keep this Age Verification Policy under regular review to reflect changes in applicable law, our verification providers, or our verification methods. We will update the “Last Updated” date at the top of this Policy when we make changes. Your continued use of the Services after an update becomes effective constitutes your acceptance of the updated Policy.
