This Privacy Policy sets out how we, Cybernet Entertainment LLC (d/b/a Kink, Kink.com, Kinkmen.com, KinkTrans.com, KinkVR.com, TwistedFactory.com and C.E. LLC), collect, store and use personal data about you, including when you use or interact with our websites (“Kink” or “the Website”) or the products or services available on our Website (collectively the “Services”), or where we otherwise obtain, receive, or collect information about you. This Privacy Policy does not address our processing of the personal data of our job applicants, employees, and independent contractors.
Please read this Privacy Policy carefully, as your access to and use of our Website signifies that you have read, understand, and agree to all terms within this Privacy Policy.
Our Services Are Not For Minors
Access to and use of the Services is forbidden to persons under the age of 18 or the applicable age of majority in the jurisdiction from which the Services are accessed ("Minors"). As indicated throughout this Privacy Policy, some users may be asked to provide additional information to us and/or our service providers to verify that they are not a Minor and to view the products and services available through the Services. We do not knowingly process Personal data of Minors. By using the Services, you represent that you are above the age of majority in the relevant jurisdiction.
Information We Collect About You
We collect or receive (i) information that you provide directly to us when you use the Services and (ii) information that is automatically collected when you use the Services. For example, information you provide directly includes information that you provide when you create an account, choose a viewing filter, rate or comment on content, add items to your Favorites, communicate with us (via email, a contact form, postal mail, or otherwise), or make purchases on the website. Information that is automatically collected includes information about your device and browser, your IP address, pages or content viewed, features used, viewing preferences, interactions with content, referring and exit pages, and the date and time of your visits. Information You Provide to Us Directly

Purposes for Which We Collect Data
We use the data we collect through your use of the website to:
- Provide and administer the Services, including to display customized content, process transactions, support the features available to you, and improve the performance of the Website;

- To determine whether users of our Website are unique, or whether the same user is using the Website on multiple occasions, and to monitor aggregate metrics such as total number of visitors, pages viewed and demographic patterns;
- Monitor and analyze trends, usage, and activities in connection with our website;
- Depending on your jurisdiction, we process identifiers, and we may use third party service providers to process biometric information, for the purpose of verifying your identity and the authenticity of the identifiers you provide when registering an account on the Website;
- Detect, investigate, and prevent fraudulent transactions, abuse, and other illegal activities;
- Troubleshooting, de-bugging, and otherwise addressing issues that may arise with the functionality of the Services;
- Perform accounting and administrative tasks, and enforce or manage legal claims;

- As we, in our sole discretion, otherwise determine to be necessary to ensure the safety or integrity of our users, employees, third parties, the public, or our company.
Biometric Information
In some jurisdictions, where the law requires, we may employ a third-party service provider to verify your identity, age, and to verify the authenticity of the identification documents you provide us using facial recognition technology. Facial recognition technology creates a mathematical representation of your facial features which are detected from the live scan of your face, your selfie, and the government-issued ID you submit or have previously submitted to us. We do not process face recognition data. Face recognition data is collected by and remains with our third-party providers, and is never provided to or accessed by us.
Where applicable, your biometric information may be processed to:
- Verify you are a real, live person and to prevent the use of methods which would allow a user to identify as someone else;
- Match your selfie with your government-issued ID which you will submit or have previously submitted to us namely to make sure that nobody is impersonating you.
You will be asked to provide your consent to biometric information processing by our third-party provider, which you may withdraw at any time by contacting us. Withdrawing your consent will not affect the lawfulness of any collection, use, processing, or disclosure that occurred prior to the withdrawal. Kink does not receive, access, or store biometric data; Kink receives only your IP address and a verification result (i.e., pass or fail).
Please note that this section entitled "Biometric Information" only applies to identifiers processed by our third-party age verification service provider for the purpose of granting you access to the Website in certain jurisdictions.
The Kink Live Platform
When you visit the Website, you can take advantage of the Kink Live live-cam channel. Kink Live is operated by Flirt4Free (“F4F”), not Kink, so when you click into Kink Live, you are leaving the Kink.com environment and entering a digital property that is fully controlled by F4F.
Notice: We may sell your personal information. Depending upon your state of residence, you may have the right under applicable privacy laws to opt out of the disclosure of your personal data to third parties. Because the automatic sharing of your registration details with F4F upon account creation may constitute a “sale” of personal data to a third party under some laws, you may have the right to opt out of this sharing before it occurs.
When you first visit the Website, you will be presented with a cookie and privacy preferences banner where required by applicable law. By clicking “Reject” on that banner, you will opt out of (i) the automatic disclosure of your registration details (including your username, email address, and IP address) to F4F at the time of account creation. If you opt out, your account will not be automatically registered with Kink Live. You may still access Kink Live separately by registering directly with F4F through the Kink Live platform, at which point F4F’s own privacy policy will govern your information.
Kink does not determine how F4F collects, uses, or discloses your personal data on Kink Live, and it does not set, monitor, or enforce F4F’s data handling practices. However, when you register with our Website, we share registration details, such as your username, email address, and IP address, with F4F to automatically register you with the Kink Live channel. This allows you to seamlessly sign into Kink Live using the same username and password that you use for our Website. If you choose to make purchases through Kink Live, we share certain tokenized payment identifiers with F4F so that F4F can authenticate your payment method without requiring you to re-enter your information.
Because Kink Live is operated by F4F, F4F’s privacy policy (https://www.flirt4free.com/privacy.php)—not this Kink Privacy Policy—will govern the personal data that is collected or processed once you are on Kink Live. We encourage you to review F4F’s privacy carefully before interacting with Kink Live content or making purchases. If you initially allow the automatic sharing of your information with F4F but later wish to opt out, you may do so at any time by updating your privacy preferences in your account settings, by adjusting your cookie preferences in your browser or by contacting us at privacy@kink.com. Upon receiving a verified opt-out request, we will cease disclosing your registration details to F4F on a going-forward basis. Please note that any information already disclosed to F4F prior to your opt-out request will be subject to F4F's privacy policy, and you should contact F4F directly to exercise any rights with respect to information already in F4F's possession.
Kink is not responsible for the privacy, security, or content practices of F4F. By accessing Kink Live, you acknowledge that Kink disclaims all liability arising from F4F’s handling of your personal data through Kink Live.
Cookies and Automatic Data Collection Technologies
When you visit the Website, Kink and third parties with whom we work, including service providers acting on our behalf (like Google Analytics, third party advertisers and third party IT service providers), use server log files and automated data collection tools like cookies, tags, scripts, customized links, device or browser fingerprints, and web beacons (together, “Data Collection Tools”) to collect personal data and other information when you access and use the Services and about your online activities over time and across third-party websites or online services. These Data Collection Tools automatically track and collect certain System Data, Technical Data, Log and Usage Data and Geographic Data (as detailed above) when you access the Services. In some cases, we tie data gathered through those Data Collection Tools to other data that we collect as otherwise described in this Privacy Policy.

The Website and our advertising partners set these cookies to provide personalized advertising and define the number of ads that will be displayed to you. Under this category, are also cross-site tracking cookies, which monitor and record users' online activities as they navigate across different websites and online platforms with the purpose to show them relevant ads. Collected data can be The data collected by these cookies could include any type of browsing information necessary to understand your browsing habits. If you choose to disable this type of cookie, you will still see advertisements, but they will be less relevant and will not be tailored to your interests.
Cookies can be either session cookies or persistent cookies. A session cookie expires automatically when you close your browser. A persistent cookie will remain until it expires, or you delete your cookies. Expiration dates are set in the cookies themselves; some may expire after a few minutes while others may expire after multiple years.
Do Not Track: Our systems do not recognize browser "Do Not Track" signals. We honor universal opt out signals like the Global Privacy Control where we are required to do so by applicable law. These are signals you can automatically send from your browser to a website to convey your choice to exercise certain opt-out rights granted by individual states. Who We Share Your Data With
With respect to residents of the European Union we will do so only insofar as there is a legal basis for the data transfer and where there is an appropriate legal basis, such as the EU Standard Contractual Clauses, to support the transfer if no adequacy decision exists. We may share your data with other Kink entities, or with third parties under the following circumstances:
With Service Providers, Contractors, and Agents
We may share your data with third-party companies who perform services on our behalf, like payment processing, data analysis, fraud detection, marketing and advertising services, email and hosting services, and customer services and support. These service providers may access your personal data and are required to use it solely as we direct, to provide our requested service.
For Analytics
As part of our use of third-party analytics tools like Google Analytics, we share certain Account Data, System Data, Usage Data (as detailed above), or aggregate information as needed.
For Security and Legal Compliance
We may disclose your data to third parties if we (in our sole discretion) have a good faith belief that the disclosure is:
- Required by law;
- Reasonably necessary as part of a valid subpoena, warrant, or other legally-valid request;
- Reasonably necessary to enforce our Terms of Use, Privacy Policy, and other legal agreements;

Marketing and Advertising
We share information with advertising partners, including but not limited to Adnium, Adsterra, and other ad networks and ad servers, in order to send you promotional communications about our Website or to show you more tailored content, including relevant advertising for third-party products and services that may be of interest to you, and to understand how users interact with advertisements. We also share personally identifiable information with third-party advertisers to enable them to provide you with opportunities to learn of products or services in which you may be interested.
These third-party advertising partners operate independently and may collect information about your visits to our website and other websites in order to provide advertisements that may be relevant to you. We do not control the data collection or privacy practices of these third-party ad networks, and their activities are governed by their own privacy policies.
- Content filter selections and browsing preferences you have set on our website;
- Non-personally identifiable usage and session data;
- Hashed or anonymized identifiers, where applicable.
We do not knowingly share your name, email address, phone number, or other directly identifiable personal information with these advertising partners for the purpose of ad targeting, unless you have provided separate, explicit consent.[BP1]
We may also share aggregate user information in a non-personally identifiable manner with advertisers and other third parties in order to present to users more targeted advertising, products and services.
With our Affiliate Program
Kink.com runs an affiliate program at (https://affiliates.kinkydollars.com/auth/login) that is owned and maintained by Everflow.
When an affiliate links traffic to Kink.com, they include query parameters that contain their affiliate account, an optional campaign tracker, and an optional custom parameter. When someone registers for the site or makes a purchase within 10 days of that affiliated traffic being seen on the site, certain personal data containing a record of the transaction is recorded within KinkyDollars (Everflow) and used to calculate payouts. No member information is stored within or sent to KinkyDollars (Everflow); only records of activity.
Retention of Personal Data
We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements. Unless we have a legal obligation or a preservation or court order which would legally oblige us to retain your personal data for a specific period, where we no longer need to process and retain your personal data in accordance with this Privacy Notice, we will delete your personal data from our systems or, where allowed by law, deidentify or anonymize your personal data.
Where required by law, we will also delete your personal data upon your request. Information on how to make a deletion request can be found below.
Data Subject Rights – Where Applicable

Residents of jurisdictions in which applicable law provides for data subject rights can exercise their privacy rights by submitting a request to us at support@kink.com or by calling us at 415-891-1515. Please note you can also exercise your rights of access, correction, or deletion of your data by following the steps in the section "Manage Your Personal Data" below. You can send an e-mail to exercise your rights, or to request us to help you with the process. We will respond to requests as required by applicable law. We may deny a request if we cannot verify the individual’s identity or if the law otherwise permits.
Prior to processing an access, correction, or deletion request of your data, we will need to verify your identity and ensure your right to access, correct or delete the information. Authorized agents may submit requests on your behalf if they provide proof of authorization, and we may also require the individual to verify their identity directly. Note that some requests to delete certain personal data will require the deletion of your user account as the provision of user accounts are inextricably linked to the use of certain personal data (e.g., your e-mail address). If you delete your account, your Personal Data and all account related information including, but not limited to, user profile data, sharing data and any data or content specifically associated with your account will no longer be accessible. If, after deleting your account, you wish to have an account with us in the future, you will have to sign up for a new account.
Where required by law, if we deny your request, we will provide instructions on how you may appeal our decision and submit a complaint. If applicable state law grants you the right to appeal our denial of your request, you may appeal our denial by contacting us at privacy@kink.com or via mail at the address listed in the “Contact Us” section below. Where required by applicable law, we will retain your request, including in order to be able to demonstrate our compliance to the respective authorities.
You may also be able to restrict the collection of personal data through your device’s operating system or by disabling cookies, but doing so may prevent you from using the functionality of the websites. Even if you opt out of the sharing or processing of your personal data for targeted advertising, you may still see our ads online at other sites and apps, and we may still base aspects of ads on your interactions with us and the websites.
Children’s Privacy
Our website is not directed to or intended for individuals under the age of 18. We do not knowingly collect personal information from children, and we require our third-party advertising partners to refrain from knowingly collecting or targeting data from users under the applicable age threshold.

Changes to Our Privacy Policy
We keep our Privacy Policy under regular review to address any new legal requirements or technical developments, or add more clarifications in the cases that are needed.
Although we may attempt to notify you when major changes are made to this Privacy Policy, you are expected to periodically review the most up-to-date version found on the Website so you are aware of any changes, as they are binding on you. If we change anything in our Privacy Policy, the date of change will be reflected in the "Last Modified" date mentioned in the header of this Privacy.
How We Protect Your Information
Kink is based in the United States. Information about you will be transferred to, and processed in the U.S. and, in some instances, in countries other than the country in which you are resident. These countries may have data protection laws that are different to the laws of your country and, in some cases, may not be as protective. We have taken appropriate steps to require that your information will remain protected in accordance with this Privacy Policy. However, no method of transmission over the internet or method of electronic storage is completely secure, so we cannot guarantee that your personal data will remain secure in all circumstances.
Our website may contain links to third party sites or online services. We are not responsible for the practices of such third parties, whose information practices are subject to their own policies and procedures, not to this Privacy Policy.

Favorites, Ratings and Comments
You may add or remove Favorites from your lists at any time by clicking the heart-shaped icon on thumbnail images or scene pages.
